This list traces how U.S. higher education has been reshaped by neoliberal policies, privatization, and data-driven management, producing deepening inequalities across race and class. Letter to Secretary of Education Miguel Cardona Regarding Borrower Defense to Repayment and Gainful Employment Regulation (Michael DiGiacomo)

Dear Secretary Cardona, Department of Education Staff, and Regulating officials,

My name is Michael DiGiacomo. I am a former student and victim of two closed for-profit scam colleges and the student loan industry. I have been fighting this industry since 2003-2006, when I realized I had been played badly by these deceptive debt factories. 
 
These "colleges," and others like them, were easily able to trick not just me, but many thousands of poor, first-time people into attending. The false promises of dream job placement stats and leads, fueled by the student loan industry's "College Students make A Million Dollars More" pitch, along with high pressure tactics, lack of financial understanding, and easy access to government funds made us all the prime target for these scamsters. 
 
They also piled on fraudulent private student loans as they worked hand-in-hand with commercial lenders to help themselves fleece the 90/10 requirement to gain more federal money funds. The promise of the future our parents and grandparents had was turned into a scam to fuel the next big bubble and wallets of those schools, the industry, and their lobbyists.  
Now, after having gone through this fight for almost 20 years, through the recruitment lies, joblessness, default, garnishment, depression, hopelessness, and the unknown, I have fought to have my federal student loans canceled as part of Sweet v Cardona [DEVOS] and the defense to repayment process. I am still miles away from relief. 
 
The paychecks, garnished for federal loan money by Sallie Mae-owned debt collectors for years, will never be returned as they somehow escape the parameters of the Sweet v Cardona [DEVOS] settlement. 
 
I spent years choosing between food or gas to get to work because federal student loan garnishments don't take those necessities into account when they rip away your paycheck. I have also not been refunded for years of payments made to the US Department of Education and Nelnet now that the federal loans have been closed in the settlement. 
 
My GI BILL even dried up/time ran out because I was too ruined financially and burned by those schools to want to finally return to ANY college again. Unfortunately, I am not alone on this. Over and over again I have heard the same stories. I have lost friends, have seen people alienate family, or even abandon our country. 
 
Now with Sweet v Cardona [DEVOS] class and post class members, I have heard that even with evidence, payments are not returned even though the loans are closed. I have seen servicers that are supposed to be helping class members [and post class] become whole pinball students away from them back to the department of education or others or give flat out incorrect information. 
 
And why does the class not cover federal loans held by Sallie Mae or other pre-Obamacare lenders? 
 
Why should the same corporate banks that helped the scamster schools be allowed to keep the funding? 
 
Why should the crooks be allowed to keep the robbery purse? 
 
Why is the process of getting a federal loan legally closed so hard?
 
Why is there no federal program in place to help with the predatory/fraudulent private student loans?
 
The processes for Defense to Repayment and the Gainful Employment regulations are hard to follow for someone as knowledgeable as myself about this, never mind a first time student or parent with no experience in the process. Clearly the "Colleges" aren't being honest in the first place to their customers, never mind slow regulators and watch dogs. 
 
I have watched the Student Aid website under serve people applying to defense to repayment they rightfully should be able to use. I have watched it only allow one school when they were hit by multiple. I have seen the website break or take minutes just to type the final name line. This is inexcusable since this is the one chance for people to make things right.  
The government guaranteed funding needs to be heavily protected on what schools get access to, and on the other side students need to be easily able to be made whole when it turns out there is systematic fraud. The fraudsters are faster than the government patches to fix it. 
 
Often when someone gets hit by one for-profit college, they get easily hit by a second one thinking the first was an isolated incident. 
 
I have watched this fight and have been part of it for too long to watch it happen all over again. Regulation needs to be strong on the part of protecting borrowers and easy for borrowers to be made whole. The promise of a government accredited college should be just that. It should not be just an arm of a corporate entity or allowed to be made "Not-for-profit" just because they worded it differently. 
 
The same corporate CEO's should not be trading companies and schools around like baseball cards or like whack a mole game once the one before it crashes down. Please put borrowers first if you want to have an educated society and protect them from corporate scamsters. And if somehow the scamsters DO get the upper-hand, please make it easier and more understandable for borrowers to get made whole.
 
When I joined the Army, I made a promise I would protect this country from all threats, foreign and domestic. The for-profit college and student loan industry is a domestic threat to this country and the public. They have decimated generations of prospective students and you still haven't fully picked up the pieces yet.

ACTION NEEDED: Proposed Rules on Student Debt Relief Based on Hardship (US Department of Education)

This is an opportunity for student loan debtors and their allies to voice their opinions about student loan debt relief. Tell them your stories and explain how this rule will help yourself and others. It can make a difference.  

The Secretary of Education proposes to amend the regulations related to the Higher Education Act of 1965, as amended (HEA), to provide for the waiver of certain student loan debts.  

The proposed regulations would specify the Secretary’s authority to waive all or part of any student loan debts owed to the Department based on the Secretary’s determination that a borrower has experienced or is experiencing hardship related to such a loan. 

DATES: The Department of Education must receive your comments on or before December 2, 2024.

Degrees of Distraction: Clickbait Culture in Higher Education Media

A growing number of mass-market media outlets like MSN are flooding social media and news aggregators with listicle-style content that oversimplifies the complex realities of higher education. These articles—such as “These 16 College Majors Lead Straight to Debt and Disappointment,” “How Student Loan Debt Can Ruin Your Life,” and “The 10 Most Difficult College Degrees & The 10 Easiest”—traffic in anxiety and fear. They promise clarity but offer only distraction, substituting nuanced analysis with sensational headlines and shallow comparisons.

The underlying message of these articles is rarely subtle: if you pick the wrong major or underestimate the burden of student loans, you’re doomed. The reader is often shown a carousel of exaggerated personal stories, stripped of context and reduced to cautionary tales. At the same time, the articles ignore the broader, systemic forces that have made higher education more financially perilous for millions of Americans.

By presenting debt as a purely personal failure rather than a predictable outcome of policy decisions, financial deregulation, and corporate capture, these pieces shift the blame away from institutions and onto individual students. They rarely address how college costs have skyrocketed while wages have stagnated, how the Department of Education has been gutted and restructured, or how student loan servicing companies routinely mislead borrowers with little accountability. They don’t examine the role of for-profit schools, accreditors, or real estate developers profiting from campus-adjacent housing. Nor do they challenge the myth that higher education is a guaranteed path to upward mobility.

Instead, they pit majors against each other. Humanities, social sciences, and creative arts are portrayed as reckless luxuries. STEM majors are celebrated as pragmatic, even though the return on investment depends heavily on where one studies, who one knows, and whether one can persist in often toxic or exclusionary academic cultures. Even the categorization of “difficult” versus “easy” majors is misleading, based more on GPA averages than actual workload, long-term intellectual challenge, or student engagement.

This kind of journalism contributes to a growing anti-intellectualism. It discourages students from following their passions or pursuing degrees that may not yield high financial returns but are essential to a functioning democracy. It feeds a cultural narrative that sees college as a consumer transaction rather than a public good. The result is a media ecosystem where student fear becomes a revenue stream, and informed decision-making is replaced by click-through bait.

These articles also crowd out deeper investigations. Where is the coverage of ongoing borrower defense claims against predatory schools? Where is the sustained attention to the impact of private equity in education? Where is the reporting on how schools game federal regulations like Gainful Employment or misuse nonprofit status to enrich executives? Instead of informing readers about these realities, MSN and similar platforms serve up recycled headlines designed to generate outrage, not insight.

The Higher Education Inquirer calls for a higher standard of reporting—one that holds power to account and equips students with more than slogans and salary charts. Young people navigating college in 2025 are not fools or naive dreamers. They are facing an increasingly rigged game, one that demands critical thinking, not consumer shaming. They deserve journalism that investigates, not indoctrinates.

Borrower Defense Stories: The Human Cost of Higher Education Fraud

Over the past month, the Higher Education Inquirer has chronicled the experiences of borrowers misled by predatory institutions—mainly for-profit colleges—through its Borrower Defense Story Series. These narratives shed light on the deeply personal consequences of institutional deception and a federal loan forgiveness process that is often slow, bureaucratic, and uneven in its outcomes.

The stories are as diverse as the students who tell them, but they share a common theme: individuals who sought to improve their lives through education but were instead left with debt, broken promises, and uncertain futures.

In the first story, “I Did Everything Right. And I’m Still Paying for a Degree I Never Got,” a single mother describes her experience at Chamberlain University School of Nursing. She followed every instruction, met every deadline, and committed herself to a profession in health care. Yet she never earned her degree. Despite this, she remains burdened with thousands of dollars in student loan debt. Her borrower defense application has yet to yield relief.

In “Anxiety & Interest (KH),” another borrower shares her journey with Kaplan University Online. Lured by promises of job placement and flexibility, KH soon realized that the school’s assurances were empty. The debt accumulated rapidly. After transferring to another college and completing her degree elsewhere, she applied for borrower defense, but the outcome remains unclear. Her story highlights the emotional and psychological toll of dealing with deceptive institutions and a broken loan forgiveness system.

The third story in the series, “Modern Indentured Servitude,” critiques the broader system of higher education finance. It describes how students—particularly those without wealth or institutional support—are drawn into debt relationships that limit their freedom, autonomy, and economic mobility. Rather than offering a pathway to security or upward mobility, college becomes a mechanism of financial entrapment.

In the most recent installment, “Fashion Gone Bad for a Private Student Borrower,” a former fashion student recounts how she took on private loans to attend a program marketed with glowing career outcomes. In reality, the education was minimal, job prospects were nonexistent, and her private loans—unlike federal loans—offered no path for borrower defense relief. The result was financial devastation with no recourse.

These stories are not isolated. As of April 30, 2024, over 974,000 borrowers had received more than $17 billion in loan discharges under the borrower defense rule. Many of these were through group claims tied to settlements involving institutions like Corinthian Colleges, ITT Tech, and DeVry. However, hundreds of thousands of other borrowers still await decisions, and many more are excluded entirely—either because they took out private loans, their schools were not included in settlements, or their claims have been delayed indefinitely.

The Borrower Defense to Repayment rule was intended to protect students from institutional fraud. But implementation has been marred by political interference, legal challenges, inconsistent enforcement, and an overwhelmed bureaucracy. The HEI story series captures what those numbers and legal filings cannot: the lived experience of people who were deceived, indebted, and left behind.

HEI continues to collect and share these narratives—not only to document harm but to advocate for deeper accountability, faster relief, and a transformation of the credential-based education economy that profits from the desperation of working-class students.

Dreams I'll Never See: Higher Ed’s Broken Promises and the American Student

“I’m hung up on dreams I’ll never see.”

That Southern rock refrain from Molly Hatchet captures the bitter reality faced by millions of Americans who invested in higher education only to be left with debt, shattered hopes, and uncertain futures.

Educator Gary Roth’s The Educated Underclass points to a growing class of credentialed individuals caught in precarious economic and social positions—overqualified yet underpaid, burdened by debt without the stability education promised. Yet it is the borrowers’ own stories that reveal the human toll behind the numbers.

Over the past month, The Higher Education Inquirer has chronicled the experiences of borrowers misled by predatory institutions—mainly for-profit colleges—through its Borrower Defense Story Series. These narratives shed light on the deeply personal consequences of institutional deception and a federal loan forgiveness process that is often slow, bureaucratic, and uneven.

In one story, a single mother describes her experience at Chamberlain University School of Nursing. She followed every instruction, met every deadline, and committed herself fully to a career in health care. Yet she never earned her degree. Despite this, she remains burdened with thousands of dollars in student loan debt. Her borrower defense application has yet to yield relief.

Another borrower shares her journey with Kaplan University Online, where promises of flexible learning and job placement proved empty. After transferring and completing her degree elsewhere, she still faces uncertainty as her borrower defense claim drags on, highlighting the emotional toll of navigating a broken loan forgiveness system.

A third story critiques the broader system of higher education finance, describing how students—especially those without family wealth or institutional support—become trapped in debt relationships that limit their autonomy and economic mobility. Rather than offering a pathway to security, college becomes a mechanism of financial entrapment.

Most recently, a former fashion student recounts how private loans—unlike federal loans—offered no path for borrower defense relief after she attended a program marketed with glowing career outcomes that never materialized. The result was devastating financial consequences with little recourse.

These individual stories are not exceptions. As of April 30, 2024, over 974,000 borrowers had received more than $17 billion in loan discharges under borrower defense rules, mostly through group claims tied to scandals involving Corinthian Colleges, ITT Tech, and DeVry. Yet hundreds of thousands still await decisions, and many are excluded entirely due to private loans, school exclusions, or bureaucratic delays.

The borrower defense rule was meant to shield students from fraud, but political interference, legal challenges, and an overwhelmed bureaucracy have marred its implementation. Behind the statistics are people deceived, indebted, and left behind.

Meanwhile, elite institutions hoard resources, adjunct faculty struggle to survive, and the promise of higher education rings hollow for many.

“I’m hung up on dreams I’ll never see.” This lyric is not just poetry but the lived reality for millions. Unless there is radical change—debt cancellation, labor protections, honest admissions, and accountability—the cycle of exploitation will only grow louder.

Some were sold dreams they could never afford. Many of those dreams are now lost.
