University of Phoenix, Oracle, and the Russian Cybercrime Crisis That Should Never Have Been Allowed to Happen

The University of Phoenix breach is more than another entry in the long list of attacks on higher education. It is the clearest evidence yet of how private equity, aging enterprise software, and institutional neglect have converged to create a catastrophic cybersecurity landscape across American colleges and universities. What happened in the summer of 2025 was not an unavoidable act of foreign aggression. It was the culmination of years of cost-cutting, inadequate oversight, and a misplaced faith in legacy vendors that no longer control their own risks.

The story begins with the Russian-speaking Clop cyber-extortion group, one of the most sophisticated data-theft organizations operating today. In early August, Clop quietly began exploiting a previously unknown vulnerability in Oracle’s E-Business Suite, a platform widely used for payroll, procurement, student employment, vendor relations, and financial aid administration. Oracle’s EBS system, decades old and deeply embedded across higher education, was never designed for modern threat environments. As soon as Clop identified the flaw—later assigned CVE-2025-61882—the group launched a coordinated campaign that compromised dozens of major institutions before Oracle even acknowledged the problem.

Among the most heavily affected institutions was the University of Phoenix. Attackers gained access to administrative systems and exfiltrated highly sensitive data: names, Social Security numbers, bank accounts, routing numbers, vendor records, and financial-aid related information belonging to students, faculty, staff, and contractors. The breach took place in August, but Phoenix did not disclose the incident until November 21, and only after Clop publicly listed the university on its extortion site. Even after forced disclosure, Phoenix offered only vague assurances about “unauthorized access” and refused to provide concrete numbers or a full accounting of what had been stolen.

Phoenix was not alone. Harvard University confirmed that Clop had stolen more than a terabyte of data from its Oracle systems. Dartmouth College acknowledged that personal and financial information for more than a thousand individuals had been accessed, though the total is almost certainly much higher. At the University of Pennsylvania, administrators said only that unauthorized access had occurred, declining to detail the scale. What links these incidents is not prestige, geography, or mission. It is dependency on Oracle’s aging administrative software and a sector-wide failure to adapt to a threat environment dominated by globally coordinated cybercrime operations.

But Phoenix stands apart from its peers because Phoenix, Apollo Global Management, and The Vistria Group should have known better. This institution has long operated at a scale more comparable to a financial-services company than a school. It handles vast volumes of sensitive data connected to federal student aid, identity verification, private loans, tuition reimbursement programs, and employer partnerships. A university with this profile should have been treating cybersecurity as a core institutional function, not an afterthought.

Apollo Global Management, which owned Phoenix during a period of enrollment decline and regulatory exposure, was fully aware of the vulnerabilities associated with online enrollment, financial-aid processing, and aging ERP infrastructure. Apollo’s business model is built on risk analysis and mitigation, yet it consistently underinvested in sustainable IT modernization while focusing on financial engineering and cost extraction. Phoenix emerged from Apollo’s ownership with significant technical debt and a compliance culture centered on limiting institutional liability rather than strengthening institutional defenses.

When The Vistria Group, through Phoenix Education Partners, acquired the university, it promised a new era of stability and digital transformation. Instead, it delivered a familiar private-equity formula: leaner operations, staff reductions, increased reliance on contractors, and deferred infrastructure investment. All of this occurred as ransomware groups such as Clop, LockBit, BlackCat, and Vice Society were escalating attacks on universities. The MOVEit crisis, the Accellion breach, and dozens of ransomware incidents had already demonstrated that higher education was an increasingly profitable target. Vistria had every signal necessary to understand the stakes, yet Phoenix entered the summer of 2025 with outdated Oracle systems, slow patch deployment, inadequate monitoring, and minimal segmentation between financial-aid and general administrative systems.

The breach was not a surprise. It was an inevitability. A university holding the sensitive financial and identity data of hundreds of thousands of current and former students, staff, and vendors cannot protect itself with minimal investment and outdated architecture. When Clop exploited Oracle’s flaw, Phoenix lacked the tools to detect lateral movement early, the expertise to identify unusual activity quickly, and the governance structure to respond decisively. The institution did not discover the breach on its own; it reacted only when a criminal syndicate announced its presence to the world.

This incident exposes a broader truth about higher education infrastructure in the United States. Universities have grown dependent on enterprise vendors whose systems are increasingly brittle and whose security models no longer meet contemporary requirements. Meanwhile, private-equity owners emphasize cost containment and short-term returns over long-term stability. The University of Phoenix breach is the result of those conditions converging with a global cybercrime ecosystem that is more organized, better funded, and more technically agile than the institutions it targets.

Students, faculty, staff, and vendors will bear the consequences for years. Many will face identity theft, fraudulent activity, and the lingering fear that their most sensitive information is circulating indefinitely on criminal marketplaces. Phoenix, like other affected institutions, will offer credit monitoring and generic assurances. But the public disclosures arrived too late, and the underlying failures were years in the making.

Phoenix should have known better.
Apollo Global Management should have known better.
The Vistria Group should have known better.
And American higher education should finally recognize that it can no longer treat cybersecurity as a line-item expense. It is now one of the central pillars of institutional survival.

National Day of Mourning: Higher Education’s Long Reckoning With Indigenous Oppression

Each November, while much of the United States celebrates Thanksgiving, Indigenous communities and their allies gather in Plymouth, Massachusetts, and across the country for the National Day of Mourning. It is a day that confronts the mythology of national innocence and replaces it with historical clarity. For Higher Education Inquirer, the significance of this day extends directly into the heart of American higher education—a system built, in no small part, on the expropriation of Indigenous land, the exploitation of Native Peoples, and the continued structural racism that shapes their educational opportunities today.

From the earliest colonial colleges to the flagship research institutions of the twenty-first century, U.S. higher education has never been separate from the project of settler colonialism. It has been one of its instruments.

Land, Wealth, and the Origins of the University

America’s oldest colleges—Harvard, Yale, William & Mary, Dartmouth—were founded within the colonial order that dispossessed Indigenous communities. While missionary language framed some of these institutions’ early purposes, they operated through an extractive logic: the seizure of land, the conversion of cultural worlds, and, eventually, the accumulation of immense academic wealth.

The Morrill Land-Grant Acts of 1862 and 1890 expanded this pattern on a national scale. Recent research documented by the “Land-Grab Universities” project shows that nearly eleven million acres of Indigenous land—taken through coercive treaties, forced removal, or outright theft—were funneled into endowments for public universities. Students today walk across campuses financed by displacements their own institutions have yet to fully acknowledge, let alone remedy.

Higher Education as an Arm of Assimilation

The United States also used education as a tool for forced assimilation. The Indian boarding school system, with the Carlisle Industrial School as its model, operated in partnership with federal officials, church agencies, and academic institutions. Native children were taken from their families, stripped of their languages, and subjected to relentless cultural destruction.

Universities contributed research, training, and personnel to this system, embedding the logic of “civilizing” Indigenous Peoples into the academy’s structure. That legacy endures in curricula that minimize Indigenous knowledge systems and in institutional cultures that prize Eurocentric epistemologies as default.

Scientific Racism, Anthropology, and the Theft of Ancestors

American universities played a central role in producing scientific racism. Anthropologists and medical researchers collected Indigenous remains, objects, and sacred items without consent. Museums and university labs became repositories for thousands of ancestors—often obtained through grave robberies, military campaigns, or opportunistic scholarship.

The 1990 Native American Graves Protection and Repatriation Act (NAGPRA) was designed to force institutions to return ancestors and cultural patrimony. Yet decades later, many universities are still out of compliance, delaying repatriation while continuing to benefit from the research collections they amassed through violence.

Contemporary Structural Racism in Higher Education

The oppression is not confined to history. Structural racism continues to constrain Native Peoples in higher education today.

Native students remain among the most underrepresented and under-supported groups on American campuses. Chronic underfunding of Tribal Colleges and Universities (TCUs) reflects a broader political disregard for Indigenous sovereignty and self-determination. Meanwhile, elite institutions recruit Native students for marketing purposes while failing to invest in retention, community support, or Indigenous faculty hiring.

Some universities have begun implementing land acknowledgments, but these symbolic gestures have little impact when institutions refuse to confront their material obligations: returning land, committing long-term funding to Indigenous programs, or restructuring governance to include tribal representatives.

What a Real Reckoning Would Require

A genuine response to the National Day of Mourning would require far more than statements of solidarity. It would involve confronting the ways American higher education continues to profit from dispossession and the ways Native students continue to bear disproportionate burdens—from tuition to cultural isolation to the racist violence that still occurs on and around campuses.

Real accountability would include:

• Full compliance with NAGPRA and expedited repatriation.
• Transparent reporting of land-grant wealth and the return or shared governance of those lands.
• Stable, meaningful funding for TCUs.
• Hiring, tenure, and research policies that center Indigenous scholarship and sovereignty.
• Long-term institutional commitments—financial, curricular, and political—to Indigenous communities.

These steps require institutions to shift from performative recognition to structural transformation.

A Day of Mourning—And a Call to Action

The National Day of Mourning is not merely a counter-holiday. It is a reminder that the United States was founded on violence against Native Peoples—and that its colleges and universities were not passive beneficiaries but active participants in that violence.

For higher education leaders, faculty, and students, the question is no longer whether these histories are real or whether they matter. They are documented. They are ongoing. They matter profoundly.

The real question is what institutions are willing to give up—land, power, wealth, or narrative control—to support Indigenous liberation.

On this National Day of Mourning, HEI honors the truth that Indigenous survival is an act of resistance, and Indigenous sovereignty is not a symbolic aspiration but an overdue demand. The future of higher education must move through that truth, not around it.

When Was Higher Education Truly a Public Good? (Glen McGhee)

Like staring at the Sun too long, that brief window in time, when higher ed was a public good, has left a permanent hole for nostalgia to leak in, becoming a massive black hole for trillions of dollars, and a blind-spot for misguided national policies and scholars alike. 

The notion that American higher education was ever a true public good is largely a myth. From the colonial colleges to the neoliberal university of today, higher education has functioned primarily as a mechanism of class reproduction and elite consolidation—with one brief, historically anomalous exception during the Cold War.




Colonial Roots: Elite Reproduction in the New World (1636–1787)

The first American colleges—Harvard, William and Mary, Yale, Princeton, and a handful of others—were founded not for the benefit of the public, but to serve narrow elite interests. Their stated missions were to train Protestant clergy and prepare the sons of wealthy white families for leadership. They operated under monopoly charters and drew funding from landowners, merchants, and slave traders.

Elihu Yale, namesake of Yale University, derived wealth from his commercial ties to the East India Company and the slave trade. Harvard’s early trustees owned enslaved people. These institutions functioned as “old boys’ clubs,” perpetuating privilege rather than promoting equality. Their educational mission was to cultivate “gentlemen fit to govern,” not citizens of a democracy.


Private Enterprise in the Republic (1790–1860)

After independence, the number of colleges exploded—from 19 in 1790 to more than 800 by 1880—but not because of any commitment to the public good. Colleges became tools for two private interests: religious denominations seeking influence, and land speculators eager to raise property values.

Ministers often doubled as land dealers, founding small, parochial colleges to anchor towns and boost prices. State governments played a minimal role, providing funding only in times of crisis. The Supreme Court’s 1819 Dartmouth College decision enshrined institutional autonomy, shielding private colleges from state interference. Even state universities were created mainly out of interstate competition—every state needed its own to “keep up with its neighbors.”


Gilded Age and Progressive Era: Credential Capitalism (1880–1940)

By the late 19th century, industrial capitalism had transformed higher education into a private good—something purchased for individual advancement. As family farms and small businesses disappeared, college credentials became the ticket to white-collar respectability.

Sociologist Burton Bledstein called this the “culture of professionalism.” Families invested in degrees to secure middle-class futures for their children. By the 1920s, most students attended college not to seek enlightenment, but “to get ready for a particular job.”

Elite universities such as Harvard, Yale, and Princeton solidified their dominance through exclusive networks. C. Wright Mills later observed that America’s “power elite” circulated through these same institutions and their associated clubs. Pierre Bourdieu’s concept of cultural capital helps explain this continuity: elite universities convert inherited privilege into certified merit, preserving hierarchy under the guise of meritocracy.


The Morrill Acts: Public Promise, Private Gains (1862–1890)

The Morrill Act of 1862 established land-grant colleges to promote “practical education” in agriculture and engineering. While often cited as a triumph of public-minded policy, the act’s legacy is ambivalent.

Land-grant universities were built on land expropriated from Indigenous peoples—often without compensation—and the 1890 Morrill Act entrenched segregation by mandating separate institutions for Black Americans in the Jim Crow South. Even as these colleges expanded access for white working-class men, they simultaneously reinforced racial and economic hierarchies.


Cold War Universities: The Brief Public Good (1940–1970)

For roughly thirty years, during World War II and the Cold War, American universities functioned as genuine public goods—but only because national survival seemed to depend on them.

The GI Bill opened college to millions of veterans, stabilizing the economy and expanding the middle class. Massive federal investments in research transformed universities into engines of technological and scientific innovation. The university, for a moment, was understood as a public instrument for national progress.

Yet this golden age was marred by exclusion. Black veterans were often denied GI Bill benefits, particularly in the South, where discriminatory admissions and housing policies blocked their participation. The “military-industrial-academic complex” that emerged from wartime funding created a new elite network centered on research universities like MIT, Stanford, and Berkeley.


Neoliberal Regression: Education as a Private Commodity (1980–Present)

After 1970, the system reverted to its long-standing norm: higher education as a private good. The Cold War’s end, the tax revolt, and the rise of neoliberal ideology dismantled the postwar consensus.

Ronald Reagan led the charge—first as California governor, cutting higher education funding by 20%, then as president, slashing federal support. He argued that tuition should replace public subsidies, casting education as an individual investment rather than a social right.

Since 1980, state funding per student has fallen sharply while tuition at public universities has tripled. Students are now treated as “customers,” and universities as corporations—complete with branding departments, executive pay packages, and relentless tuition hikes.


The Circuit of Elite Network Capital

Today, the benefits of higher education flow through a closed circuit of power that links elite universities, corporations, government agencies, and wealthy families.

  1. Elite Universities consolidate wealth and prestige through research funding, patents, and endowments.

  2. Corporations recruit talent and license discoveries, feeding the same institutions that produce their executives.

  3. Government and Military Agencies are staffed by alumni of elite universities, reinforcing a revolving door of privilege.

  4. Elite Professions—law, medicine, finance, consulting—use degrees as gatekeeping mechanisms, driving credential inflation.

  5. Wealthy Families invest in elite education as a means of preserving status across generations.

What the public receives are only residual benefits—technologies and medical innovations that remain inaccessible without money or insurance.


Elite Network Capital, Not Public Good

The idea of higher education as a public good has always been more myth than reality. For most of American history, colleges and universities have functioned as institutions of elite reproduction, not engines of democratic uplift.

Only during the extraordinary conditions of the mid-20th century—when global war and ideological conflict made mass education a national imperative—did higher education briefly align with the public interest.

Today’s universities continue to speak the language of “public good,” but their actions reveal a different truth. They serve as factories of credentialism and as nodes in an elite network that translates privilege into prestige. What masquerades as a public good is, in practice, elite network capital—a system designed not to democratize opportunity, but to manage and legitimize inequality.

Blue Falcons: Politicians, Government Agencies, and Nonprofits Serve Themselves, Not Those Who Have Served

“Blue Falcon”—military slang for a “Buddy F****r”—refers to someone who betrays their comrades to get ahead. It’s a fitting label for disgraced U.S. Congressman Duncan Hunter, a Marine Corps veteran convicted of misusing campaign funds while cloaking himself in patriotic rhetoric. But Hunter isn’t alone. He’s emblematic of a broader betrayal—one that involves politicians, bureaucrats, predatory schools, and veteran-serving nonprofits. Together, they form an ecosystem where self-interest thrives, and veterans are left behind.

Despite endless platitudes about “supporting our troops,” the systems designed to serve veterans—especially in education—are failing. Two of the most generous and ambitious benefits ever created for veterans, the Post-9/11 GI Bill (PGIB) and Department of Defense Tuition Assistance (TA), are now riddled with waste, abuse, and profiteering. The real beneficiaries aren’t veterans, but an extensive network of for-profit colleges, lobbying firms, and institutions that exploit them.


The GI Bill and DOD Tuition Assistance: A Pipeline for Predators

The Post-9/11 GI Bill was supposed to be a transformative benefit—a way to reward veterans with the chance to reintegrate, retrain, and succeed in the civilian world. At more than $13 billion annually, it is the single most generous higher education grant program in the country. According to a report highlighted by Derek Newton in Forbes, the GI Bill now costs more than all state scholarships and grants combined and represents half of all Pell Grant spending.

And yet, it isn’t working.

A groundbreaking study from the National Bureau of Economic Research (NBER)—conducted by researchers from Texas A&M, the University of Michigan, Dartmouth, William & Mary, and even the U.S. Department of the Treasury—delivers a scathing indictment of the program’s effectiveness. According to the report, veterans who used PGIB benefits actually earned less nine years after separating from the military than peers who didn’t attend college at all. The researchers found:

“The PGIB reduced average annual earnings nine years after separation from the Army by $900 (on a base of $32,000). Under a variety of conservative assumptions, veterans are unlikely to recoup these reduced earnings during their working careers.”

The reason? Too many veterans are enrolling in heavily marketed, low-value schools—institutions that offer little return and often leave students without degrees or meaningful credentials. Veterans from lower-skilled military occupations and those with lower test scores were particularly likely to fall into this trap. These “less advantaged” veterans not only saw worse labor market outcomes but were more likely to spend their GI Bill benefits at for-profit schools with dismal outcomes.

Even worse, the report estimated that the cost to taxpayers for every additional marginal bachelor’s degree produced by PGIB is between $486,000 and $590,000. That’s beyond inefficient—it’s exploitative.

In the Forbes article we put it bluntly:

“This is sad to say, that the GI Bill does not work for many servicemembers, veterans and their families. What's even sadder is that if you drill into the data, to the institutional and program level, it will likely be worse. There are many programs, for-profit and non-profit, that do not work out for servicemembers, veterans, and their families.”


Tuition Assistance and the DOD’s Open Wallet

The Department of Defense’s Tuition Assistance program also faces exploitation. With few controls, it serves as an open faucet for bad actors who aggressively recruit active-duty service members through deceptive advertising, partnerships with base education offices, and endorsements from shady nonprofits. Just as with the GI Bill, predatory institutions see DOD TA not as an education resource, but as a predictable stream of federal cash.

Military leadership has done little to intervene. The same institutions flagged for fraud and poor outcomes continue to operate freely, bolstered by industry lobbyists and revolving-door influence in Washington.


Nonprofits and Politicians: Wolves in Patriotic Clothing

The betrayal doesn’t stop with colleges. Many large veteran-serving nonprofits and “military-friendly” initiatives exist more for image than impact. Instead of helping veterans, they prop up harmful systems and launder legitimacy for the very institutions exploiting the military community.

Meanwhile, Congress talks a big game but routinely fails to act. Lawmakers from both parties show up for ribbon cuttings and Veterans Day speeches, but many take campaign donations from subprime colleges and education conglomerates that prey on veterans. They refuse to close known loopholes—like the infamous 90/10 rule—that incentivize for-profit schools to chase GI Bill funds with deceptive tactics.

And all the while, the Department of Veterans Affairs (VA)—underfunded, overburdened, and politically manipulated—struggles to provide the basic services veterans were promised.


A Sad Reality, and a Call to Action

It’s a bitter irony that programs designed to lift up veterans often lead them into deeper debt, poorer job prospects, and wasted years. The data from NBER, the findings from watchdogs like Derek Newton, and the lived experience of thousands of veterans all point to one conclusion: the Post-9/11 GI Bill, as currently administered, is failing. And so is the broader system around it.

Veterans deserve better. They deserve:

  • Strict oversight of predatory colleges and training programs

  • Transparency in outcomes for veteran-serving nonprofits

  • Accountability from lawmakers and government agencies

  • Equitable investment in public and community college options

  • A fundamental shift from patriotic lip service to real systemic reform

Until then, the Blue Falcons will continue to circle—posing as allies while feasting on the very benefits veterans fought to earn.

What caused 70 US universities to arrest protesting students while many more did not?

Earlier this year, the New York Times reported that about 3100 people had been arrested at pro-Palestinian campus protests across the US, noting that 70 schools had arrested or detained people. In addition to arrests, a varying degree of force has been used, including the use of targeted police surveillance, tear gas, and batons. 

After those arrests, some schools expelled those protesting students, banned them from campuses, and denied them degrees. Schools also established more onerous policies to stop occupations and other forms of peaceful protest. A few listened to the demands of their students, which included the divestment of funds related to Israel's violent occupation of Palestine. 

What can students, teachers, and other university workers learn from these administrative policies and crackdowns? The first thing is to find out what data are out there, and then what information is missing, and perhaps deliberately withheld.

Documenting Campus Crackdowns and Use of Force

The NY Times noted mass arrests/detentions at UCLA (271), Columbia (217), City College of New York (173), University of Texas, Austin (136), UMass Amherst (133), SUNY New Paltz (132), UC Santa Cruz (124), Emerson College (118), Washington University in Saint Louis (100), Northeastern (98), University of Southern California (93), Dartmouth College (89), Virginia Tech (82), Arizona State University (72), SUNY Purchase (68), Art Institute of Chicago (68), UC San Diego (64), Cal Poly Humboldt (60), Indiana University (57), Yale University (52), Fashion Institute of Technology (50), New School (43), Auraria Campus in Denver (40), Ohio State University (38), NYU (37), Portland State University (37), University of North Carolina, Chapel Hill, (36), University of Pennsylvania (33), George Washington University (33), Stony Brook University (39), Emory University (28), University of Virginia (27), Tulane University (26), and University of New Mexico (16). In many cases, court charges were dropped but many students faced being barred from campuses or having their diplomas withheld.

The Crowd Counting Consortium at Harvard University's Kennedy School has also been keeping data on US protests and their outcomes from social media, noting that "protest participants have been injured by police or counter-protesters — sometimes severely — about as often as protesters have caused property damage, much of which has been limited to graffiti." Their interactive dashboard is here.  

According to a Foundation for Individual Rights and Expression (FIRE) database, out of 258 US universities that held protests, only 60 schools resorted to arrests.* Why did these schools, many name-brand schools, use arrests (and other forms of threats and coercion) as a tactic while others did not? A number of states reported no arrests, particularly in the US North, South, and West.

Analyzing the Data For Good Reasons

There appear to be few obvious answers (and measurable variables) to accurately explain this multi-layered phenomenon, something the media have largely ignored. But that does not mean that this cannot be explained to a better extent than the US media have explained it.

It's tempting to look at a few interesting data points (e.g. according to FIRE, Cornell University and Harvard did not have arrests, and neither did Baylor, Liberty University, and Hillsdale College. Six University of California schools had arrests but three did not. And all of the schools that came before the US House of Representatives Judiciary Subcommittee examining antisemitism (Harvard, Penn, MIT) had arrests after their appearances. The Arizona House had similar hearings in 2023 and 2024 regarding antisemitism and their two biggest schools, Arizona State University and the University of Arizona, had arrests.

Missing Data and Analysis

What else can we notice in this pattern about the administrations involved, the trustees, major donors, or the student body? How much pressure was there from major donors and trustees and can this be quantified? Anecdotally, there were a few public reports from wealthy donors who were unhappy with the protests. Who were those 3100 or so students and teachers who were arrested and what if any affiliations did they have? How many of the students who were arrested Jewish, and what side were they on? How many of these schools with arrests had chapters of Students for Justice in Palestine and Students Supporting Israel? How many schools with these student interest groups did not resort to arrests?

How much communication and coordination was there within schools and among schools, both by administrations and student interest groups? What other possible differences were there between the arrest group and the non-arrest group and are they measurable?

What other dependent variables besides arrests could be or should be be measured (e.g. convictions, fines and sentences, students expelled or banned from campus)? What will become of those who were arrested? Will they be part of a threat database? Will this interfere with their futures beyond higher education? Is it possible to come up with a path analysis or networking models of these events, to include what preceded the arrests and what followed? And what becomes of the few universities that operate more like fortresses today than ivory towers? How soon will they return to normal?

Democratic Protests on Campus: Modeling the Better World We Seek (Annelise Orleck)

As an aging college professor, I found myself in a surprising position on the evening of May 1: face down in the grass of the Dartmouth College Green, with a heavily armored riot policeman kneeling on my lower back, and three others holding me immobile. Police wrenched my arms painfully behind me as they roughly tightened plastic zip ties on my wrist that cut sharply into my skin. “You’re hurting me,” I cried. “Please stop.”

I found myself croaking the words that I have heard so many victims of police brutality say before me: “I can’t breathe.” One of the officers growled at me, “You can talk. You can breathe.” I thrashed and gasped for air, while they threatened to charge me with resisting arrest, then pulled me up hard to my feet and pushed me toward a college van that the administration had provided police to facilitate the only mass arrests I have seen in my thirty-four years of teaching at Dartmouth.

Like many colleges and universities, after student encampments spread across the country calling for a ceasefire in Gaza and for divestment from companies that profit from Israel’s war, Dartmouth had banned tents on the Green. College policy violations don’t usually result in arrests, so Dartmouth chose to press charges against protesters for “criminal trespass.” As a recent court order made clear, “the State arrested each named defendant at Dartmouth College’s behest.”

When New Hampshire riot police arrived, there were ten students sitting quietly in five tents, surrounded by maybe 150 supporters, who had linked arms around them. It was a notably diverse protest, with Jewish, Christian, Muslim and Buddhist faith communities involved.

Over the years, there have been myriad peaceful student-led protests on the Dartmouth Green: to support campus unions, denounce sexual violence, call for divestment from fossil fuels and, before that, from companies that profited from South African apartheid. There have been rallies decrying racist statements in the famously conservative Dartmouth Review, calling for protection of undocumented students and opposing the incarceration of migrant children. 

Not since the late 1960s has Dartmouth called in riot police to assault protesters. Across the country, student protest has flourished largely unrestrained on college campuses since the disastrous 1970 crackdowns at Kent State in Ohio and Jackson State in Mississippi cost six students their lives. Why now are we seeing beatings and arrests of thousands? What moved college administrators this spring to make such a sharp change in how they handle peaceful student protest?

On the night of May 1, eighty nine people, myself included, were brutally arrested by phalanxes of heavily armed men in full body armor with helmets, truncheons, police dogs, and an armored vehicle. They descended alongside several local police forces, apparently called in by the college president and the Republican Governor of New Hampshire, Chris Sununu, who, hours earlier, had condemned campus protests for peace in Gaza as “100 percent antisemitic.”

A disproportionate number of those arrested that night were students of color. Their own experiences of state violence and discrimination have sensitized them to the suffering of Palestinians. Some of the arrested were, as I am, Jewish. This fact reflects the broader movement for a ceasefire in Gaza, which contains a disproportionate number of Jews who are moved by our religion’s call for tikkun olam (repair of the world) to denounce the genocide being committed in our names. The narrative promoted by politicians, many media pundits and supporters of Israel that these protests are “100 percent antisemitic” is, on my campus and many others, 100 percent untrue.

These violent crackdowns on campuses have been executed in the name of fighting antisemitism, defending free speech and keeping campuses “safe.” Dartmouth’s president and other college administrators have argued that calling riot police and arresting protesters is not an infringement of their rights to free expression. Rather, they insist, there are proper and improper ways to protest. “Occupations,” (the word they use to describe the tent encampments student protesters have used to evoke the situation in which more than a million displaced Gazans are now living,) infringe on the freedom of those who disagree with the protesters, making them uncomfortable and perhaps physically impeding them as they walk to or from classes or dorms. Some Jewish students who have suffered such discomfort have filed class action lawsuits against their universities for not protecting them.

Regardless of where you stand on whether campus officials should arrest peaceful protesters whose speech is making some other students feel uncomfortable, it is crucial to recognize that this new campaign against alleged anti-Semitism on campuses is not instigated by Jewish undergraduates who feel unsafe. It is well-funded and well-coordinated by powerful organizations with international reach – some of them funded to the tune of tens of millions of dollars by wealthy conservative donors from the U.S. and Israeli state coffers. The Institute for the Study of Global Anti-Semitism and Policy,closely tied to Israel’s ruling Likud party, has provided research and data to members of Congress and state governments seeking to pass anti-Boycott Divestment and Sanctions laws. ISGAP research was also cited in Republican-led Congressional hearings investigating the so-called rise of “anti-semitism” on college campuses.

While ISGAP has concentrated on government agencies, many suits against colleges and universities have been litigated by the Louis D. Brandeis Center, founded in 2011 to combat civil rights violations against Jewish or Israeli students. The Brandeis Center usually sues for violations of Title VI of the Civil Rights Act of 1964 which forbids discrimination against or exclusion of anyone on the grounds of race, color or national origin in any program receiving federal funds. It has launched suits and legal complaints against Columbia, Harvard, University of Vermont, American University, Brooklyn College, Tufts, the University of Southern California and many other campuses. The Center has also promised to clean up “the morass of Middle Eastern studies,” mounting complaints against 129 Middle Eastern studies programs and centers on campuses.“When universities fail to comply with their legal obligations,” the Brandeis web site declares, “the center holds them accountable by taking legal action.”

Does all of this make politicians and college administrations tread carefully when students protest Israeli policy? You bet. The massive P.R. campaign to delegitimize criticism of Israel has also powerfully influenced mainstream media coverage of the protests. It has been not just relentlessly negative but wildly alarmist: one CNN anchor compared the campus protesters to Hitler youth on campuses in the 1930s; an MSNBC host compared the protesters to those who stormed the Capitol on January 6, arguing that campus protests are motivated only by hate.

As an historian of U.S. politics and social protest movements, it seems clear to me that we are in the grip of a national mass hysteria – not unlike the Red and Lavender Scares of the post-World War II years, when Hollywood actors, writers, New York schoolteachers and postal service workers, federal employees in Washington, D.C. were called in front of Congressional investigating committees and interrogated about past Communist Party sympathies or hidden gay lives.

In that era, Communists and gay people were painted as threatening to U.S. national security, because Communists were thought to want to give away secrets to our enemies and closeted gay people were seen as vulnerable to blackmail by foreign spies. Now it is critics of Israel’s war in Gaza who are seen as threats to U.S. national security, because they question long-standing agreements to supply billions in weapons annually to our primary ally in the Middle East. The U.S.-Israel relationship makes a few people (some of whom are on the Boards of Trustees of colleges and university campuses) a lot of money. 

In 2022, more than 2/3 of foreign investment in Israel came from the U.S. And Israel’s investments on the tech-heavy NASDAQ exchange are fourth in the world – smaller only than those of the U.S., Canada and China. Seen in that light, we can understand why student protesters’ calls for colleges and universities to divest from companies tied to Israel are being seen by Trustees and politicians alike as an existential threat. Dartmouth’s president is a director of the largest hedge fund on earth, headed by an Israeli tech guru and which invests heavily in Israeli technology.

Money is certainly part of what is fueling the bi-partisan response of politicians to this year’s wave of student protests. Politicians heavily funded by Israel’s premier lobbying firm – the American Israel Public Affairs Committee – are more than happy to conflate criticism of Israeli policy with anti-Semitism. Just as members of both parties in Congress -- from the 1940s through the early 60s -- feared being called soft on Communism, now politicians are weaponizing fears of a “new anti-Semitism” to further their own political agendas and line their pockets– bolstering military and technology contractors in Israel and the U.S. as they rile up voters in the 2024 election cycle. Fear sells. It generates both profits and votes.

That’s where the campaign of shock and awe came in. It all happened so quickly it was head spinning. 

On April 27, a student protest at Washington University in St. Louis resulted in 100 arrests. Steve Tamari, a Palestinian history professor from a nearby university, was thrown to the ground by police with such force that he suffered multiple broken ribs and a broken hand. His crime – filming the police action. 

On April 30, the New York Police Department made 300 arrests at Columbia and City College, barricading students into their dorm rooms, jailing protesters without water for 16 hours, holding two in solitary confinement. 

On May 2, the Los Angeles Police Department broke up an encampment of UCLA student protesters. For hours they watched as a right-wing mob (of self-proclaimed Zionists some of whom were armed thugs with ties to actual neo-Nazi and anti-LGBTQ groups) beat them, shot fireworks at them, then sprayed chemical irritants. When the LAPD did step in, officers shot unarmed peace protesters and faculty in the chest, face, arms and legs with “less than lethal” munitions. 

According to one volunteer medic, injured protesters were prevented from seeking much-needed hospital care until police had zip tied and arrested them.

The carnage continued at the University of Virginia where -- seven years earlier – actual neo-Nazis had marched with torches chanting Jews Will Not Replace Us. No police moved in to stop them. But, on May 4, 2024, Virginia riot police called in by UVA’s president pepper-sprayed and violently arrested peaceful protesters, destroying both tents and students’ belongings. 

Two and a half weeks later, on May 21, riot police used gas and chemical irritants to break up a Gaza ceasefire protest at the University of Michigan, on a part of campus that – like our Green - has hosted peaceful protests for decades without incident.

More than 3,100 were arrested at Gaza protests on college campuses from April to June 2024. ACLED (the Armed Conflict Location and Event Data Project) found that 97.4% of these protests were completely peaceful. Most of those arrested, myself included, were charged with criminal trespass – standing on the property of the institutions where they study and work. Interestingly, prosecutors from Manhattan to Austin have begun to drop charges against hundreds of protesters, for lack of evidence and – as one Indiana prosecutor put it – because the charges are “constitutionally dubious.” So far, New Hampshire has refused that route.

This theater of repression did what it was supposed to: bringing in riot police makes it seem that peaceful protest is actually threatening. And those who cracked down on the threat were lauded. In late June, Dartmouth was cited in the Chronicle of Higher Education as the only Ivy League campus not investigated by Congress for anti-Semitism. Our president continued to insist that she was acting in defense of free speech when she called armed police to arrest peaceful protesters.

Similarly, Republican congressional interrogators gloated over the resignations of the Presidents of Harvard and the University of Pennsylvania late last year. In mid-May, as riot police were flooding campuses to “clear” encampments, Elise Stefanik and Virginia Foxx called to Capitol Hill the Presidents of Northwestern University and Rutgers University, where administrators chose to negotiate rather than call police on their own students. The irony of a Jewish, pro-Israel university president Michael Schill, being dressed down by Republican House members with ties to actual white supremacist, homophobic, antisemitic and Islamophobic organizations, should not have been lost on anyone. But alas it was. Because that is how mass hysterias work.

Some of the loudest self-appointed Congressional defenders of American Jewry supported the January 6, 2021 assaults on Capitol Hill, where some protesters wore Camp Auschwitz shirts and others wore clothing with the logo 6MWE – which means 6 Million Wasn’t Enough. Those same members of Congress are now convening hearings to “investigate” how anti-Semitism is allegedly running rampant on college campuses and in K-12 schools.

There’s another piece to this perfect storm. Calling in armed state police to beat and jail teenage protesters may be seen as an alarming new stage in a 70-year-war by conservative politicians and intellectuals to “retake” higher education from “tenured radicals” who, allegedly, poison students’ minds by radicalizing them. Israel and its supporters have their agenda right now regarding campuses but so too do conservative educators and politicians.

The war on campus radicals can be traced at least as far back as William Buckley’s 1951 polemic, God and Man at Yale. It heated up with Roger Kimball’s 1990 screed, Tenured Radicals: How Politics Has Corrupted Our Higher Education. In 1994, Lynn Cheney, former head of the National Endowment for the Humanities, rejected the American History Standards she had commissioned (and which were worked on by actual American historians) as paying too much attention to “obscure” figures like Underground Railroad conductor Harriet Tubman and embarrassing topics like Red Scares and the KKK, and not enough to Confederate generals like Robert E. Lee or inventors like Orville and Wilbur Wright, the so-called fathers of aviation.

Those first battle cries were alarming at the time. They seem almost quaint now. The assault on education has intensified mightily since 2010, with the passage of book bans,bans on trans children competing in team sports and “divisive concepts” laws in more than 20 states that forbid teachers to discuss anything that makes students or, more likely, parents uncomfortable. In some districts this has meant a ban on teaching the history of slavery, systemic racism, sometimes the Holocaust, and certainly anything positive about LBGTQ people. Along with riot police on campus, have come new policies ending or drastically limiting Diversity, Equity and Inclusion programs, and calls for an end to Middle Eastern Studies programs, Women’s, Gender and Sexuality Programs and more.

The bans on teaching the history of minority communities in the U.S. being waged in Florida, Texas and other states, go hand in hand with a spate of laws introduced since the racial justice protests of 2020 to criminalize protest in general. Teaching “divisive concepts” – conservative education officials assert, fuels protests. Post-9/11 anti-terrorism legislation is now being adapted so that all kinds of acts of civil disobedience–blocking pipelines, roads and bridges for example – can be prosecuted as terrorism and protesters can be harshly punished.

A series of steps now being considered in Washington, D.C. (and state capitols) will take us farther down that slippery slope. H.R. 6408, which has already passed the U.S. House and is awaiting consideration in the Senate, will give the Secretary of the Treasury unilateral power to terminate the tax-exempt status of any organization that provides “material support” – and that includes speech acts – to any terrorist organization.

This helps to explain why Columbia University suspended its campus chapters of Students for Justice in Palestine and Jewish Voices for Peace. While there is zero evidence of any links between those groups and Hamas, Israeli government-funded campus surveillance agencies such as Canary Mission, along with the Anti-Defamation League and AIPAC, have repeatedly charged campus activists with providing aid and comfort to Hamas. That charge has been echoed ad infinitum by some vehemently pro-Israel faculty, students and administrators. 

If H.R. 6408 becomes law, we will undoubtedly see numerous colleges and universities suspending or banning student groups engaged in protest – not just of Israeli policy but also of U.S. foreign policy. Student protesters talk of a “Palestine exception” to free speech protections. But if these bills become law, protest for any reason will be subject to harsh punishment.

As part of the crackdown on recent calls for ceasefire in Gaza, Congress reauthorized an expanded version of Section 702 in April. This post-9/11 program of warrantless mass surveillance (including private communications) has already been used against Black Lives Matter activists and journalists. A proposal to reform Section 702 to require warrants for surveillance of U.S. citizens was defeated, with the ADL and other pro-Israel groups arguing that it would hamstring surveillance of “pro-Palestinian” movements.

There has been, without doubt, a rise in anti-Semitism in this country and around the world. But the most worrisome antisemitism is not coming from student protesters calling for an end to the horrific war in Gaza. In the age of Trump we have seen the rise of a vast network of violent white supremacist, anti-Semitic, Islamophobic and homophobic groups. Frighteningly, most of them are armed to the teeth with actual weapons of war. Continued erosion of any kind of gun control makes them more dangerous than ever.

But I want to go one step farther and say that - like the Red Scare of the 1950s, the violent crackdown on student and faculty protest over the past few months is itself antisemitic. It has targeted Jews disproportionately, seeks to enforce through state violence, surveillance, and legislation, a particular political stance that all Jews must adhere to, and insists that if Jewish students and faculty ally with Muslims, Christians and Buddhists to oppose Israeli policy, we can all be charged with supporting terrorism.

It seeks to eviscerate the rich array of Jewish identities – which have always included people critical of Zionism. There is no room in this view for Jews whose identity is rooted in the long tradition of Jewish support for minority and worker rights, democratic pluralism and social justice.

It is ironic, even tragic, that campus protesters have been so demonized. Because, in some very real ways, the student encampments have modeled the new world that we must bring into existence if there is to be peace, in Israel/Palestine and beyond. At encampments across the country, Jewish and Muslim students have broken bread together, prayed together and shared insights and rituals from their religious traditions. These students—the very same ones we are targeting for arrest, beatings, suspensions and expulsions—may just be leading us toward new visions of what is possible. And, in these dark times, we need that if we are to move forward.

The Tragedy of Human Capital Theory in Higher Education (Glen McGhee*)


Have you ever wondered why US student loan debt has soared past all other debt but mortgages, to more than $1.7 trillion?  Did you know $500 billion of that outstanding student loan debt will never be paid back to the US Treasury and that this huge black-hole is sucking the life from Millennials in debt peonage?  

And did you know all of this mess can be attributed directly to a set of misguided economic nostrums that go by the name of "Human Capital Theory"?

This is the tragedy of deeply flawed Human Capital Theory.  Having hijacked notable successes with professionalization (remember: not everyone can be a "professional"), human capital theorists in the early 1960s worked to spread and legitimize the idea that "learning means earning."

The sinister-side is that for the lucky ones, the motto proved true.  But today's grievously high debt burdens and the growing number of precarious jobs for those not so lucky contradicts the idea that "learning means earning."  

The seeds of Human Capital Theory have been growing for more than century, first through Madison Avenue marketing and then University of Chicago myth making. 

Here's an ad from September 1920 issue of Popular Science Monthly that makes the point: the possession of knowledge means higher wages. In this case, the 1920's proprietary “correspondence” schools and colleges relied heavily on this basic message to sell themselves -- what was later to become the central tenet of Human Capital Theory.


The naivete of these one-hundred year old advertisements is obvious now. We know better; whether it's through our own bitter experience, or the experience of those around us -- life is not so simple. Such simplicity has been debunked, and the idea itself that knowledge always translates into higher earnings has lost its appeal.

But at the time, these advertisements picked up on the massive surge in economic changes -- the new jobs, new occupations, new companies -- sweeping the county. Commerce and business life expanded and was transformed in numerous ways. Using 1880-1930 census data, Cristina Groeger shows how upper-class elites benefited far more than, say, those suffering from racial discrimination that barred them completely from higher-wage employment.

Sadly, Human Capital Theory does not take any of this into account. Racial and gender-based discrimination through our social institutions is, unfortunately, completely missing from Human Capital Theory. Learning does not equal earning when you lack access to job opportunities due to discrimination, or when you were born to a certain set of parents at a certain place, at a particular point in time.

For those lucky enough to ride the wave of growing prosperity, the slogan was true. And that's what has been driving support for Human Capital Theory -- it's just a glimpse in a 100 year old rear-view mirror. Public policy at the federal level, state level -- and even local support of education -- has been premised on the myth that financial support of education "equals earnings" -- for everyone. This is, of course, not true for those faced with wage stagnation, high unemployment and under-employment, automation, out-sourcing of good jobs, and skill erosion -- all these factors come into play and complicate the picture.

Worse yet is the global reach of these misguided directives to developing nations to spend freely on education.

In 1960, Theodore Schultz highlighted the importance of human capital for economic development among poor nations in his presidential address to the American Economic Association. “Human capital investing” soon became a priority among economic development specialists and policy makers through the World Bank and the efforts of the Chicago School. "Learning means earning" became World Bank gospel, linking GDP and economic growth with a nation's investment in higher education. The Chicago School apparently falsified the direction of causality between higher education and economic growth, resulting in additional tragical consequences on a global scale.

Not all economists, however, are so deeply committed to Human Capital Theory.

In fact, the number of dissenters is on the rise, and include Phillip Brown, Hugh Lauder and Sin Yi Cheung, the authors of The Death of Human Capital?

University of Oxford economist Kate Raworth has developed "doughnut economics" as an alternative approach, even going so far as to encourage "guerrilla economics" and declaring "it's time to vandalize the economic textbooks"!

David Blanchflower, former Bank of England governor and Dartmouth economics professor, is another highly vocal critic of human capital theory. Cristina Groeger's History of Education in Boston 1880-1930: The Education Trap is another critique that runs the length of an entire book.

Gradually, the human capital theorists that were so popular in the 1960s and 1970s are being replaced by a new cohort that isn't interested in supporting outdated dogma.

But tragically, the damage has been done, and economists need to be held accountable. They can start by joining those that are denouncing Human Capital Theory.

Even Elite Schools Have Subprime Majors (Keil Dumsch and Dahn Shaulis)

Even elite US universities have academic majors that result in negative or low returns on investment (ROI).   The Higher Education Inquirer I looked at some of America's most elite schools and found the worst performing majors at each school.  You can find the information yourself by going to the US Department of Education's College Scorecard.  

While the College Scorecard has limitations, including incomplete and missing data, it can still be used as one tool for choosing a college and a major to study.  The College Scorecard has a section for every school called "Salary After Attending." 

If you click on "View More Details" you can see several sections, including a section titled "Salary after Completing."  If you take a look at the range and hover over the low you see the major that had the lowest performing major in terms of salaries.  

The salary ranges for some schools are enormous, and it's amazing what you will find for low salary majors at elite schools. Some may argue that the salaries are misleading if people go on to grad school or medical school, but many do not.  And of those who do continue their studies some still end up as post docs or in other less than optimum jobs while holding an even larger amount of debt.  CalTech is the only school that does not have a low-ROI major.
